Terms of service

1. Use of Our Services

Delegate® Studio provides design, strategy, and production services, including subscription-based offerings. Our services are intended for professional and commercial use only. You agree to use our services in a lawful manner and not for any purpose that violates applicable laws, regulations, or third-party rights.

We reserve the right to refuse service, suspend access, or terminate accounts at our discretion if these Terms are violated.

2. Subscriptions and Billing

Some services are offered on a subscription basis, billed either monthly or annually, as described at the time of purchase.

By starting a subscription, you authorize us to charge the applicable fees using your selected payment method. Subscription fees are billed in advance and renew automatically unless cancelled.

You are responsible for ensuring that your billing information remains accurate and up to date.

3. Pausing and Cancelling Subscriptions

You may pause or cancel your subscription at any time through the designated account management process or by contacting us.

Pausing a subscription temporarily suspends service delivery for the duration of the pause period. Billing may also be paused depending on the terms of your specific plan.

Cancellation stops future billing and service from the end of the current billing cycle. Services already delivered or currently in progress will not be reversed.

4. Refund Policy

Monthly subscriptions are non-refundable. Once a monthly billing period has started, no refunds are issued for that period.

Annual subscriptions may be cancelled within the first four weeks of the initial subscription term. In such cases, you may be eligible for a refund of up to 80 percent of the annual fee. The remaining portion accounts for onboarding, setup, and initial service availability.

After the first four weeks, annual subscriptions are non-refundable.

5. Service Availability and Changes

We aim to provide consistent and reliable service, but we do not guarantee uninterrupted availability. Access may occasionally be limited due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of our services at any time. Where reasonably possible, we will provide advance notice of material changes.

6. Intellectual Property

All content, materials, and deliverables provided by Delegate® Studio remain our intellectual property unless otherwise agreed in writing. Upon full payment, clients receive the usage rights explicitly outlined in their service agreement or scope of work.

You may not copy, distribute, modify, or reuse our materials beyond the agreed usage without prior written consent.

7. Limitation of Liability

Delegate® Studio shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or services. Our total liability shall, in all cases, be limited to the amount paid by you for the services in the twelve months preceding any claim.

Nothing in these Terms limits liability where such limitation is not permitted by law.

8. Third-Party Services

Our services may integrate or rely on third-party tools or platforms. We are not responsible for the availability, functionality, or policies of these third-party services.

Your use of third-party services is subject to their own terms and conditions..

9. Termination

We reserve the right to terminate or suspend your access to our services if you breach these Terms or misuse the services. Termination does not entitle you to a refund except as outlined in our Refund Policy.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the site or services after changes take effect constitutes acceptance of the revised Terms.
